Terms of Service

These Terms govern your use of zosh.health and app.zosh.health (the “Service”), operated by Zosh Health & Wellness (“Zosh”, “we”, “us”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
Not for emergencies. Zosh is not an emergency or crisis service. If you are in danger or thinking of harming yourself, call 112 (emergency services in India), or reach a helpline such as iCall 9152987821 or the Vandrevala Foundation 1860-2662-345 (24×7).
1. Eligibility
You must be 18 or older to create an account. A person under 18 may use the Service only with the consent and supervision of a parent or lawful guardian.
2. What Zosh is
Zosh is a digital, evidence-based sleep-health programme — primarily Cognitive Behavioural Therapy for Insomnia (CBT-I) — together with educational content and, where offered, access to consultations with sleep professionals.
3. What Zosh is not
Zosh is not a medical device and is not a substitute for professional medical advice, diagnosis, or treatment, and it is not an emergency service. Always seek the advice of a qualified clinician with any questions about a medical condition.
4. Medical & safety disclaimer
CBT-I includes techniques — such as sleep restriction — that are not suitable for everyone. Do not begin or self-manage intensive sleep restriction, and seek clinical supervision first, if you have bipolar disorder, a seizure disorder, untreated obstructive sleep apnoea, or responsibilities requiring sustained alertness (for example driving or operating machinery). Follow the safety guidance shown in the programme, and consult a clinician where indicated.
5. Your account
Keep your login credentials secure and provide accurate information. You are responsible for activity under your account. Tell us promptly if you suspect unauthorised use.
6. Acceptable use
Do not misuse the Service: no unlawful use, no attempts to disrupt, probe, or reverse-engineer it, and no uploading of another person’s data without their authority.
7. Consultations & clinicians
Where consultations are offered, participating clinicians are responsible for their own clinical judgement and advice. Zosh facilitates access and supporting tools; it does not practise medicine.
8. Payments & refunds
Paid features, where available, are billed through our payment provider. Prices and any applicable refund terms are shown at the time of purchase. [Insert refund / cancellation policy.]
9. Intellectual property
The Service and its content are owned by or licensed to Zosh. We grant you a limited, personal, non-transferable licence to use the Service. Your own data remains yours.
10. Third-party services
The Service relies on third-party providers (for authentication, hosting, analytics, email, and payments). Your use of those services may also be governed by their own terms.
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. We do not guarantee any specific health outcome.
12. Limitation of liability
To the maximum extent permitted by law, Zosh will not be liable for indirect, incidental, or consequential damages, and our total liability is limited to [the amount you paid for the Service in the preceding 12 months / a stated cap].
13. Indemnity
You agree to indemnify Zosh against claims arising from your misuse of the Service or breach of these Terms.
14. Termination
We may suspend or end your access if you breach these Terms. You may stop using the Service at any time and request deletion of your data (see our Privacy Policy).
15. Governing law & jurisdiction
For users in India, these Terms are governed by the laws of India, subject to any applicable consumer-protection rights. As we expand to other countries, the governing law and venue for users in those countries will be published here alongside the local terms that apply to them. Registered entity and venue details will be published once incorporation formalities are complete.
16. Changes to these Terms
We may update these Terms from time to time. Continued use after changes take effect means you accept them; we will notify you of material changes.
